Workset Terms of Use

Effective [EFFECTIVE DATE] · Last updated [EFFECTIVE DATE]

These Terms of Use (“Terms”) are an agreement between you and Skynet Coaching Inc. (“Skynet,” “we,” “us”), the company that makes Workset. They apply to the Workset apps for iPhone and Android, our website at workset.me, and anything else we offer under the Workset name (together, “Workset”). Please read them, especially three sections: Health & fitness, Subscriptions & billing, and Dispute resolution. If you live in the United States, Dispute resolution requires most disputes to be settled by individual arbitration rather than in court or in a class action, unless you opt out within 30 days. Our Privacy Policy explains how we handle your information.

Agreeing to these Terms

By creating an account or using Workset, you agree to these Terms and confirm that you've read our Privacy Policy. If you don't agree, don't use Workset.

If you got Workset from the Apple App Store or Google Play, the store's terms also apply to you. See “App Store and Google Play.”

Who can use Workset

You must be at least 13 years old to create an account. Workset is not intended for children under 13.

If you're under 18, or under the age of majority where you live, you may use Workset only with permission from a parent or legal guardian. That parent or guardian must agree to these Terms on your behalf and is responsible for your use of Workset. Parents and guardians: please go through the Health & fitness and Community sections with your teen, because Workset includes posting, profiles that show training to other members, and direct messages.

You can't use Workset if we've previously removed your account, or if the laws that apply to you bar you from using it, including U.S. sanctions.

Workset is for your own personal, non-commercial training.

Your account

Give us accurate information and keep it up to date. Your onboarding answers, such as your maxes, bodyweight and training history, shape your program, so inaccurate answers can produce training that doesn't suit you.

Keep your password private. You're responsible for activity on your account. If you think someone else has accessed it, change your password and contact us at [SUPPORT EMAIL].

Each account is for one person. Don't share, sell or transfer your account. We may reclaim or change a username that impersonates someone, infringes a trademark or breaks our community guidelines.

Health & fitness

WORKSET IS NOT MEDICAL ADVICE. POWERLIFTING AND OTHER STRENGTH TRAINING CARRY A RISK OF SERIOUS INJURY AND, IN RARE CASES, DEATH. YOU TRAIN AT YOUR OWN RISK.

Workset provides general training information and tools. It isn't a medical service or a medical device, and it doesn't replace advice from a doctor, physical therapist or other qualified professional. Nothing in Workset diagnoses, treats or prevents any condition.

Talk to a doctor before you start a new program. This matters most if you are pregnant or have recently given birth, have a heart or blood-pressure condition, have a current or past injury or any other medical condition, or take medication that could affect exercise.

Heavy training is demanding. Lifting maximal or near-maximal loads, testing maxes and taking meet attempts can cause muscle and tendon tears, joint and back injuries, and cardiovascular events. Warm up, use sound technique, train in a safe space with appropriate equipment (such as collars, safety bars or spotters), and lift within your ability on the day.

You decide what you lift. Programs, prescribed weights, RPE targets, estimated maxes, readiness scores and attempt suggestions are estimates that software produces from the information you enter. They can be wrong, out of date or unsuitable for you on a given day, and an estimated max is not a weight you are ready to lift. Workset can't see you train and can't detect pain, fatigue, poor technique or injury. Adjust or skip anything that doesn't feel right. Stop immediately and seek medical help if you feel pain, dizziness, chest pain, shortness of breath or anything else unusual.

The readiness check-in is a training tool, not a medical assessment. Meet-day features are planning aids. We don't run competitions, and your federation's rules, officials and judging apply. If you're under 18, train under the supervision of a qualified adult.

To the extent the law allows, you voluntarily accept the risks of the training you do, including training you do with Workset. In an emergency, call your local emergency number.

Our Athlete Coaches

Workset's programs are built around the training approaches of elite powerlifters we work with (“Athlete Coaches”). They are currently Ashton Rouska, Jesus Olivares, Joe Borenstein and Natalie Richards. When you join a coach's team, that coach's approach shapes the program our software builds for you: how training is periodized, which exercises are used and how loads progress.

Athlete Coaches are independent athletes who work with us under separate agreements [COACH COMPENSATION DISCLOSURE — CONFIRM]. They are not Skynet employees, and they don't speak for Skynet.

Our software generates your program from your answers and your coach's approach. No Athlete Coach writes or adjusts your program for you individually, and Athlete Coaches don't monitor or review your training. Like other members of your team, they can see what your profile setting shows your team; our Privacy Policy explains what that is.

Athlete Coaches may share things with their teams, such as announcements, coach notes in your program or messages in a team group chat. What they share is general and isn’t tailored to you. They don’t give individual coaching, medical or physical therapy advice through Workset, and they may not reply to direct messages.

Meet-day coaching lines and lift call-outs, session headlines and recaps, and weekly titles are written by AI, not by your Athlete Coach. See “AI-assisted features.”

The list of Athlete Coaches can change, and we can't guarantee that any particular coach will stay involved. If a coach leaves, we may ask you to choose another team.

AI-assisted features

An AI model provided by Anthropic writes some short text in Workset: your weekly dashboard title, session headlines, session recaps, and meet-day coaching lines and lift call-outs. It works from a summary of your training data, as our Privacy Policy describes.

Your program itself is built by our own program-generation software from your answers and your coach's approach. It isn't written by a generative AI model.

AI-generated text can be inaccurate, incomplete or inappropriate. It isn't professional or medical advice, and it doesn't come from your Athlete Coach. Don't rely on it for safety decisions, including which weight to attempt. Use your own judgment and follow the guidance in “Health & fitness.”

When you post a session, its headline is AI-generated unless you write your own. Review it before you post, because you're responsible for what you share.

AI features have daily usage limits, and we may change, limit or turn off AI features at any time. Don't try to manipulate them into producing harmful content or revealing how they work.

Subscriptions & billing

Workset requires a paid subscription. You can buy one in the app, through the Apple App Store or Google Play, or on our website. Before you buy, we show you the price and billing period (in the app, in your local currency). In the app we currently offer a monthly subscription, and on our website we offer monthly, six-month and yearly subscriptions. A subscription bought on our website works in the Workset app on iPhone and Android.

How you pay in the app. Subscriptions bought in the app are sold through the Apple App Store and Google Play. They're charged to your Apple ID or Google account when you confirm the purchase. Apple and Google process the payment, and we never see your card details. The store includes or adds taxes as required where you live, and its terms and payment policies also apply to your purchase.

How you pay on our website. Subscriptions bought on our website are sold by Skynet, and our payment processor, Stripe, takes the payment for us. You're charged when you confirm the purchase, or when your free trial ends if you have one, and again at the start of each new billing period until you cancel. Stripe handles your card details, and we never see your full card number. Where we're required to charge sales tax or VAT, it's added at checkout. [CONFIRM ONCE STRIPE TAX IS SET UP] If you use a promotion code, its discount applies as described when you redeem it. Stripe's privacy policy covers how Stripe handles your payment information.

Automatic renewal. Your subscription renews automatically at the end of each billing period, at the price then in effect, until you cancel. For a subscription bought in the app, the store charges the renewal within the 24 hours before the current period ends, so cancel at least 24 hours before then to avoid being charged for the next period. For a subscription bought on our website, the renewal is charged when the new period starts, so cancel any time before the current period ends.

Free trials. If we offer a free trial, we show how long it lasts before you start. Unless you cancel before the trial ends (at least 24 hours before, for a subscription bought in the app), your paid subscription starts automatically and you'll be charged. If you buy a subscription during a trial, the rest of the trial ends.

How to cancel on iPhone or iPad: open Settings, tap your name, tap Subscriptions, choose Workset and tap Cancel Subscription. You can also go to https://apps.apple.com/account/subscriptions.

How to cancel on Android: open the Google Play Store app, tap your profile icon, then Payments & subscriptions, then Subscriptions. Choose Workset and tap Cancel subscription. You can also go to https://play.google.com/store/account/subscriptions.

How to cancel a subscription bought on our website: sign in at workset.me with Log in at the top of the page, choose Manage subscription on your account page, then Cancel subscription.

Cancellation takes effect at the end of the current billing period, and you keep access until then. Deleting the app or your Workset account doesn't cancel your subscription, so cancel first: through the store for a subscription bought in the app, or on our website for one bought there. Once your account is deleted you can't sign in to cancel a website subscription yourself, so contact us at [SUPPORT EMAIL] if that happens.

Refunds. For a subscription bought in the app, the store you bought from handles refunds under its own policies, and we can't issue refunds for App Store purchases. To ask for one, use https://reportaproblem.apple.com for Apple, or Google Play's refund process (https://support.google.com/googleplay/answer/2479637) for Google; for a Google Play purchase you can also contact us at [SUPPORT EMAIL]. For a subscription bought on our website, contact us at [SUPPORT EMAIL]. Payments are non-refundable unless the store's policy or the law says otherwise, and we don't give refunds or credits for partial periods or unused time.

If you live in the EU or UK, you may have a legal right to withdraw from a purchase within 14 days. For subscriptions bought through Apple or Google, the store handles withdrawal requests under its own terms. For a subscription bought on our website, contact us at [SUPPORT EMAIL] within 14 days of buying it. [WITHDRAWAL TERMS FOR WEBSITE PURCHASES — COUNSEL TO CONFIRM]

Price changes. We may change subscription prices. For a subscription bought in the app, the store will tell you in advance, and will ask you to agree to the new price before it applies where its rules or the law require that. For a subscription bought on our website, we'll email you at least [PRICE CHANGE NOTICE PERIOD] before a new price applies. If you don't want to pay the new price, cancel before it takes effect.

Restoring purchases. If you reinstall Workset or switch devices, sign in to the same store account and tap “Restore purchase” on the subscribe screen. A subscription bought on our website belongs to your Workset account, so signing in to Workset is enough.

One subscription at a time. Workset checks for an existing subscription before you buy, in the app or on our website, so you aren't billed twice. If you think you have been, contact us at [SUPPORT EMAIL].

App Store and Google Play

If you downloaded Workset from the Apple App Store, Apple's Licensed Application End User License Agreement (the “Standard EULA,” https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also governs your use of the app, unless and to the extent these Terms supersede it as Apple permits. You and we also agree to the following.

These Terms are between you and Skynet only, not Apple. Skynet, not Apple, is solely responsible for the Workset app and its content.

Your license to use the app covers Apple-branded devices that you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions permit. Other accounts associated with you through Family Sharing or volume purchasing may also access it.

Apple has no obligation to provide maintenance or support for the app.

If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent the law permits, Apple has no other warranty obligation for the app.

Apple isn't responsible for addressing any claims by you or a third party relating to the app or your use of it. These include product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.

Apple isn't responsible for investigating, defending, settling or discharging any third-party claim that the app or your use of it infringes that party's intellectual property rights.

You confirm that you are not located in a country subject to a U.S. Government embargo, or one the U.S. Government has designated as “terrorist supporting.” You also confirm that you are not on any U.S. Government list of prohibited or restricted parties.

When you use the app, you must comply with any third-party terms that apply, such as your mobile data agreement.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple may enforce them against you.

If you downloaded Workset from Google Play, the Google Play Terms of Service also govern your use of Google Play, including purchases.

Community & your content

Workset lets you share posts, photos, videos, comments, reactions and messages with other members (“your content”). You choose who can view each session when you finish it, and your profile setting controls who can open your profile, including the training shown on it. Our Privacy Policy explains exactly who can see what. Messages are seen by the people in the conversation.

You own your content. When you share it on Workset, you give Skynet a worldwide, non-exclusive, royalty-free license, which we may sublicense to our service providers, to host, store, copy, adapt (for example, resize or transcode), display and distribute it. We use this license only as needed to operate, provide and improve Workset, for example to show your post to the audience you chose and send notifications about it.

This license ends when your content is deleted from Workset, except for copies others have already received (such as messages), backup copies kept for a limited time, and copies we must keep for legal reasons.

You're responsible for your content. Share only what you have the right to share, and get permission before posting photos or videos in which other people can be identified.

Other members' content belongs to them, not to us. We don't endorse it, and we aren't responsible for it or for how members behave, whether on Workset or when they meet in person.

We don't review content before it's posted, and we aren't obliged to monitor Workset. We may still review, remove or restrict content, and suspend or remove accounts, that we reasonably believe break these Terms or put others at risk.

To have one of your own posts or comments removed, contact us at [SUPPORT EMAIL]. You can delete your own chat messages from the message's menu.

Community guidelines, reporting & blocking

Workset is a training community, and we have zero tolerance for objectionable content and abusive members. Don't post or send anything that:

harasses, bullies, threatens or intimidates anyone, or attacks people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age or another protected characteristic;

contains nudity or sexual content. Anything that sexualizes minors is strictly prohibited, and we report child sexual exploitation to the National Center for Missing & Exploited Children as the law requires;

shows graphic violence, or encourages self-harm, suicide or disordered eating;

promotes or arranges the sale or use of illegal or controlled substances, including performance-enhancing drugs used without a prescription;

is spam, a scam, advertising or unsolicited commercial messaging;

impersonates another person, including an Athlete Coach or a member of Workset staff, or misrepresents your connection with anyone;

shares someone else's personal information or images without their permission;

infringes someone else's copyright, trademark or other rights, or is otherwise illegal.

Reporting. To report a post, open the post's menu, choose Report and pick a reason. To report a chat message, open the message's menu and choose Flag Message. To report a comment, a profile, a member or anything else, email [SUPPORT EMAIL] with the member's username and what happened. We review reports [REPORT RESPONSE TIME], and we may remove content and suspend or remove the member responsible. If someone is in immediate danger, contact local emergency services first.

Blocking. You can block a member from a post's menu, from their profile or from a chat message's menu. Once you do, you won't see their posts or comments, your one-to-one chats with them are hidden, and they can't start a new one with you. Blocking doesn't affect group chats you both belong to, and it doesn't delete their content, which other members can still see. You can unblock someone from their profile.

Acceptable use

When using Workset, don't:

break the law or violate anyone's rights;

access or try to access accounts or data that aren't yours, including other members' information beyond what the Workset app shows you;

use our servers, databases or credentials outside the Workset app;

scrape, crawl or collect data from Workset by automated means;

copy, modify, distribute, sell or lease any part of Workset, or reverse engineer or decompile it, except where the law allows this despite this restriction;

copy, publish or sell Workset programs, or use Workset to provide paid coaching or other commercial services to others;

get around the subscription, usage limits, blocks or security measures;

interfere with or overload Workset, or upload viruses or other harmful code;

create accounts in bulk or by automated means, or create a new account after we've removed yours;

use Workset to build a competing product.

Intellectual property

Workset belongs to Skynet or our licensors and is protected by intellectual property laws. That includes its software, program designs, exercise library, text, graphics and videos, and our Athlete Coaches' training approaches as Workset expresses them. Apart from your content, we and our licensors keep every right these Terms don't expressly grant.

We give you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Workset app on devices you own or control, and to use Workset for your personal, non-commercial training under these Terms.

“Workset” and the Workset logo are trademarks of Skynet Coaching Inc. Athlete Coaches' names and likenesses belong to them. Apple, App Store, Google Play and other third-party marks belong to their owners. Don't use our marks without our written permission.

If you send us feedback or ideas, we may use them without any obligation to you.

Copyright complaints

We respond to notices of copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA). If you believe content on Workset infringes your copyright, send our designated agent a notice that includes:

your physical or electronic signature;

identification of the copyrighted work;

identification of the material you say infringes and where it appears on Workset, such as the member's username and the post;

your contact information;

a statement that you believe in good faith that the copyright owner, its agent or the law has not authorized the use;

a statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or are authorized to act for the owner.

Designated agent: [DMCA AGENT NAME, ADDRESS, EMAIL].

If we removed your content and you believe that was a mistake, you can send a counter-notice as the DMCA allows. In appropriate circumstances, we terminate the accounts of repeat infringers.

Third-party services

Workset works with services that other companies run, such as the App Store, Google Play, Stripe (for payments on our website), YouTube (for exercise demonstration videos), Instagram (if you choose to share a workout card) and our support messenger. Their own terms and privacy policies apply, and we aren't responsible for them. Links to other sites are there for convenience only.

New features and changes to Workset

Workset is new, and some of its features are still being developed. Features may be incomplete, may change or be removed, and may have errors, including errors that affect your training data. Keep your own record of anything important to you, such as meet attempts.

We may change, add or remove features, or stop offering Workset, at any time. If we stop offering Workset, we'll give you reasonable notice where we can.

Termination & account deletion

You can stop using Workset at any time. To delete your account, go to Settings > Account Settings > Delete Account. You'll be asked to confirm and re-enter your password. If you can't sign in, you can request deletion at [ACCOUNT DELETION REQUEST URL].

Deleting your account doesn't cancel your subscription, so cancel it first, through the App Store, Google Play or our website. Our Privacy Policy explains what is deleted and what we keep.

We may suspend or end your access, remove content or delete your account if you break these Terms, if the law requires us to, or if your use creates risk or possible legal exposure for us, other members or the public. We'll tell you when we reasonably can, unless doing so would compromise safety, an investigation or the law. If you think we made a mistake, contact [SUPPORT EMAIL].

When your account ends, your license to use Workset ends too. Sections that by their nature should survive will survive. These include Health & fitness, Community & your content (the license for content shared before deletion, to the extent described there), Intellectual property, Disclaimers, Limitation of liability, Indemnification, Dispute resolution and Governing law.

Disclaimers

WORKSET IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW PERMITS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

In plain terms, we don't promise that Workset will be uninterrupted, error-free or secure. We don't promise that programs, estimates, readiness scores, attempt suggestions or AI-generated text will be accurate or right for you, or that you'll reach any particular strength, performance or competition result. Some places don't allow these disclaimers, so some of them may not apply to you.

Limitation of liability

TO THE FULLEST EXTENT THE LAW PERMITS, SKYNET, ITS ATHLETE COACHES, AND THEIR AND SKYNET'S OFFICERS, EMPLOYEES AND SUPPLIERS WON'T BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF WORKSET.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO WORKSET IS LIMITED TO THE GREATER OF [LIABILITY CAP AMOUNT] OR THE AMOUNT YOU PAID FOR WORKSET IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits apply whatever the legal theory, and even if we were told the damage was possible. They don't limit any liability that the law doesn't allow us to limit, such as liability for gross negligence or willful misconduct where that applies. If you live in the EU or UK, nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else your local law doesn't allow us to limit.

Indemnification

To the extent the law permits, you agree to defend and indemnify Skynet and its Athlete Coaches, officers, employees and suppliers against third-party claims, and the related losses and reasonable legal costs, that arise from your content, your breach of these Terms, or your violation of the law or of someone else's rights. For consumers in the EU or UK, this applies only as far as local law allows.

Dispute resolution & arbitration (U.S. users)

This section applies if you live in the United States. It doesn't apply if you live in the EU, EEA or UK.

Talk to us first. Before starting a claim, email [LEGAL EMAIL] with your name, your account email, a description of the dispute and what you're asking for. We'll do the same if we have a dispute with you. Both sides will try in good faith to resolve the dispute within [INFORMAL RESOLUTION PERIOD] before either starts arbitration.

Binding individual arbitration. If we can't resolve the dispute, you and Skynet agree that any dispute arising from or relating to these Terms or Workset will be resolved by binding individual arbitration, administered by [ARBITRATION PROVIDER AND RULES]. The Federal Arbitration Act governs this section.

A single arbitrator decides the dispute and may award the same relief a court could, but only to you individually. Hearings will take place by video. If the arbitrator decides an in-person hearing is needed, it will take place in [ARBITRATION HEARING LOCATION] or in the county where you live, whichever you choose. Your fees will be no more than the administrator's consumer filing fee, and we'll pay the rest of the administrator's fees and the arbitrator's fees.

Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also ask a court for an injunction to stop infringement or misuse of intellectual property.

YOU AND SKYNET EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION OR ARBITRATION. If this waiver is found unenforceable for a particular claim, that claim will go to court as described in “Governing law & venue,” not to class arbitration.

Opting out. You can opt out of this arbitration agreement within 30 days of first accepting these Terms. Send a notice with your name, your account email and a clear statement that you're opting out to Skynet Coaching Inc., Attn: Legal Department, [MAILING ADDRESS], or by email to [LEGAL EMAIL]. Opting out doesn't affect anything else in these Terms.

Changes. If we change this section, the change won't apply to any dispute that either of us had already raised with the other. You may also reject the change by telling us within 30 days of the change taking effect.

Governing law & venue

If you live in the United States, the laws of the State of [GOVERNING LAW STATE] govern these Terms, without regard to conflict-of-laws rules, and the Federal Arbitration Act governs the arbitration section. Any claim not subject to arbitration will be brought in the state or federal courts located in [VENUE COUNTY], [GOVERNING LAW STATE], and you and we consent to their jurisdiction.

If you live in the EU or EEA, [EU GOVERNING LAW] governs these Terms, and you may bring proceedings in the courts of the country where you live. This doesn't take away the protection of the mandatory consumer laws of that country.

If you live in the UK, [UK GOVERNING LAW] governs these Terms, and you may bring proceedings in the courts of the part of the UK where you live. This doesn't affect your mandatory consumer rights.

If you live anywhere else, the laws of the State of [GOVERNING LAW STATE] apply, subject to any mandatory consumer protections where you live.

California consumer notice

Workset is provided by Skynet Coaching Inc., [MAILING ADDRESS]. The app and our website show current charges before you subscribe.

Under California Civil Code Section 1789.3, California users are entitled to the following notice. Changes to these Terms

We may update these Terms. If a change is material, we'll tell you in the app or by email before it takes effect. The date at the top shows when the Terms last changed. Changes don't apply retroactively.

If you keep using Workset after a change takes effect, you accept the updated Terms. If you don't agree, stop using Workset, cancel your subscription and delete your account.

General

These Terms, our Privacy Policy and any terms shown to you for a specific feature are the entire agreement between you and Skynet about Workset.

If any part of these Terms is unenforceable, the rest stays in effect. If we don't enforce a provision right away, we haven't waived it.

You may not transfer your rights under these Terms. We may transfer ours to an affiliate, or as part of a merger, acquisition or sale of assets.

We aren't responsible for delays or failures caused by events beyond our reasonable control.

You must comply with the U.S. and other export control and sanctions laws that apply to your use of Workset.

We may send you notices by email, in the app, or by posting them on workset.me. Send legal notices to Skynet Coaching Inc., Attn: Legal Department, [MAILING ADDRESS], with a copy to [LEGAL EMAIL].
